As part of the Energy Performance of Buildings Directive, a Building Energy Rating (BER) certificate, which is effectively an energy label, isrequired at the point of sale or rental of a building, or on completion of a new building.
The BER will be accompanied by an "Advisory Report" setting out recommendations for cost-effective improvements to the energy performance of the building.
There is no legal obligation on vendors or prospective purchasers to carry out the recommended improvements. BER certificates will be published by the SEAI on a public BER Register.
The requirement to provide a BER certificate for a building is being introduced in the following stages:
- From 1 January 2007, a Building Energy Rating (BER) certificate will be required by law for new dwellings, for which planning permission has been applied for on or after this date, when they are offered for sale or rent.
- From 1 July 2008, a Building Energy Rating (BER) certificate will be required by law for all new non-residential buildings for which planning permission is being applied for.
- From 1 January 2009, a Building Energy Rating (BER) certificate will be required by law for all existing buildings, when they are offered for sale or rent.
It should be noted that currently some local authorities require provisional BER certificates to be lodged with the planning application documents for new buildings.
The Dwelling Energy Assessment Procedure (DEAP) is the official procedure in Ireland for calculating and assessing the energy performance of new dwellings.
The assessment of the energy performance of buildings can only be carried out by a registered BER assessor in accordance with the requirements of the EPBD Regulations.
